Terms of Service

These Terms of Service (“Terms”) govern your use of Cellar, the marketing site at https://cellar.fm, related download services, and optional donations.

1. The product

Cellar is an independent desktop client for YouTube Music on macOS and Windows. It is not affiliated with, or endorsed by, YouTube or Google. You need your own YouTube Music / Google account to use Cellar.Cellar is free to download and use. There is no license key and no subscription.

2. Eligibility

You must have legal capacity to enter into a binding contract. Where you are an EU consumer, mandatory consumer rights prevail over conflicting terms to the extent required by law.

3. Google / YouTube relationship

Cellar does not replace your Google account. You must comply with Google’s and YouTube’s terms when using their services through Cellar. We are not responsible for Google or YouTube outages, policy changes, or account actions taken by Google.

4. Use of Cellar

• You may download Cellar from https://github.com/timlangner/cellar/releases/latest and use it on as many of your own devices as you like.
• You receive a personal, non-exclusive, non-transferable right to use Cellar. You may not resell Cellar, claim affiliation with YouTube or Google, or use Cellar in violation of applicable law or third-party intellectual property rights.
• We may provide updates at our discretion while we maintain the product. We do not promise perpetual compatibility with YouTube Music APIs or services.

5. Optional donations

You may optionally support Cellar (for example by buying a coffee). Donations are voluntary. They help development and cover server costs. They are not required to download, install, or use Cellar, and they do not unlock extra features or a paid license.

Donation checkout is handled by Ko-fi at https://ko-fi.com/cellarfm. Ko-fi’s own terms and privacy policy apply to that checkout. Tips are treated as voluntary and freely given. If something went wrong with a tip, email support@cellar.fm.

6. Taxes

The operator is a small business under German Kleinunternehmen § 19 UStG.

7. Acceptable use

You may not abuse the Services, attempt unauthorized access, or use Cellar in violation of applicable law or third-party intellectual property rights.

8. Intellectual property

We own the Cellar software, branding, and site content (except third-party materials). YouTube, Google, and related marks belong to their respective owners.

9. Disclaimer

To the maximum extent permitted by law, the Services are provided as is. Mandatory consumer warranties remain unaffected.

10. Liability

• Liability is unlimited for intent, gross negligence, injury to life, body, or health, and under the German Product Liability Act (ProdHaftG).
• For slight negligence, we are liable only for breach of essential contractual duties, and then limited to foreseeable, typical damage.
• We are not liable for Google / YouTube outages or account actions outside our control.
• Mandatory consumer rights remain unaffected. For business customers, the exclusive venue is Nordhorn, Germany, where permitted.

12. Suspension and termination

We may suspend or terminate access for material breach of these Terms. You may stop using Cellar at any time.

13. Changes

We may update these Terms by posting a revised version with a new “Last updated” date.

14. Governing law and disputes

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). EU consumers keep mandatory protections of their country of residence. The European Commission’s Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. We are not obliged to participate in a consumer arbitration board (Verbraucherschlichtung).

15. Severability and entire agreement

If a provision is invalid, the remaining Terms continue in effect. These Terms, together with the linked policies and Ko-fi’s checkout terms for optional donations, form the entire agreement regarding the Services.
